Statutory Procedures

The statutory procedures governing the construction and improvement of trunk roads are contained in The Roads (Northern Ireland) Order 1993. The Roads (Amendment) (Northern Ireland) Order 2004 came into operation on the 18 January 2005 allowing the three strands of the statutory procedures - Environmental Statement, Direction Order and Vesting Order - to be taken forward concurrently.


Statutory Procedures require the production of:

ENVIRONMENTAL STATEMENT

The Environmental Statement gives details of the Proposed Scheme, the impacts on the surrounding landform and community and the proposals for mitigation of those impacts. It also contains an outline of the alternatives considered and the reasons for Roads Service’s selection of the Proposed Scheme.

ENVIRONMENTAL STATEMENT ADDENDUM

At the time of publication of the Environmental Statement it was indicated that a review of traffic data was being undertaken in light of a number of modifications to the proposed horizontal and vertical alignment prior to finalising the Proposed Scheme. The Environmental Statement Addendum contains further assessments of the Proposed Scheme relative to air quality and noise and vibration.

VESTING ORDER

The Vesting Order is required to transfer clear title for all land required for the scheme.

DIRECTION ORDER


The Direction Order is a legal process required to modify or create a length of “Trunk Road”. It would normally include the provisions for any of the consequent stopping up of other roads affected by the construction of new road. The Proposed Scheme for the new road is published, together with an illustrative map, in the Notice of Intention to Make a Direction Order.

This includes the provisions for any stopping up of private accesses onto the new road.

All documents and maps relating to the Scheme may be inspected and further information relating to the proposals may be obtained by any person, free of charge, at all reasonable hours during the period from 16 November 2010 to 21 January 2011 at the Roads Service offices of:

  • Western Division, County Hall, Drumragh Avenue, Omagh;
  • Boaz House, 15 Scarffe’s Entry, Omagh;
  • Omagh Section Office, 32 Deverney Road, Arvalee, Omagh;
  • Dungannon Section Office, Moygashel Depot, Main Street, Moygashel;
  • Strabane Section Office, 20 Derry Road, Strabane;
  • Headquarters, Room 2-13, Clarence Court, 10-18 Adelaide Street, Belfast;
  • Northern Division, Derry Section Office, 1 Crescent Road, Londonderry;

and at the offices of-

  • Dungannon and South Tyrone Borough Council, Circular Road, Dungannon;
  • Strabane District Council, 47 Derry Road, Strabane;
  • Derry City Council, 98 Strand Road, Londonderry; and
  • Omagh District Council, The Grange, Mountjoy Road, Omagh.

In addition, the Environmental Statement may also be inspected at all reasonable hours during the same period at the offices of Monaghan County Council, Roads Office, MTEK II Office, Armagh Road, Monaghan, Co. Monaghan and Donegal County Council, Public Services Centre, Drumlonagher, Donegal Town Co. Donegal.

Any person who wishes to express an opinion on the Environmental Statement or to object to the making of The Trunk Roads T3 and T6 (Western Transport Corridor) Order (Northern Ireland) 2010, The Private Accesses at A5 Western Transport Corridor (Stopping-Up) Order (Northern Ireland) 2010 or the proposed Vesting Order must, on or before 21 January 2011, write to the Divisional Roads Manager, Department for Regional Development, Roads Service – Western Division, County Hall, Drumragh Avenue, Omagh BT79 7AF, stating their opinion on the Environmental Statement and/or the grounds of their objection to the proposed Orders. The Department will take into consideration any representations made before deciding whether or not to proceed with the project with or without modifications.
